The Feydey LLC (USA) and Non-Profit Educational Association Swiss Innovators Club (Switzerland) are owners of the trademark GSED® (Global Secondary Education Diploma), and all FEYDEY and GSED® programs and Privacy Policy provide you with information on what data we collect, what we use it for and what are your rights.

- we do not collect more information than is necessary,
- we do not use your data for purposes other than those specified,
- we do not keep your data if it is no longer needed,
- we do not spread/sell your data to third parties,
- we collect data based on "legitimate interest" only.


Also, FEYDEY and GSED® comply with the Family Educational Rights & Privacy Act (FERPA) to protect all student information released by district/school for educational purposes.

Children under the age of 13 years need enhanced safeguards and privacy protection, as outlined in the Children's Online Privacy Protection Act (COPPA).

COPPA specifies the consent of parents/guardians for collecting or using any personal information of children under the age of 13.

FEYDEY and GSED® comply with COPPA and receive personal information about children who are under the age of 13 strictly from their parents or guardians at the time those children are enrolled into a school using a FEYDEY School Program. The only information received directly from children are the test answers, emails, and class discussions in the LMS as part of their education in a FEYDEY School Program GSED®.

As of January 1, 2016, the Student Online Personal Information Protection Act (SOPIPA) becomes effective in California. The law prohibits the sharing of student data and using that data for advertising. FEYDEY and GSED® comply with the law and do not share information for non-educational purposes.

Anyone may read the information provided through our site's message boards, blogs, and chat rooms. All information posted to a message board or chat room will be available to other users and no longer be private. This information is provided at your own risk, and though we may monitor the message, we cannot guarantee the security of such information.

To reduce unauthorized access and maintain adequate, practical data accuracy and use, we use SSL protocol on the accounts to protect any sensitive information, like credit card numbers.

That https://swissinnovatorsclub.ch contains links to websites operated by other organizations and third-party service providers. The privacy policy set by FEYDEY and GSED® does not apply to these third-party websites. Please take a few minutes to review the privacy policies of the third-party websites that you access.


WHAT IS THIS NOTICE?
To provide our Services, we may need to process Personal Data from time to time (that is, information about someone who can be identified from the data). This Personal Data may be about you or other people. This notice explains how we will use the Personal Data we hold.

We are a Controller regarding the following data: (Name, Last name, DOB, place of birth, email, ph. and/or mob. number, address, school name, grade, interest, skills, credentials and knowledge. This means we decide what data to collect (concerning those groups of Data Subjects) and how to use it.

We are Processors of payment information, credit cards, and bank accounts. This means we are processing that data on behalf of (and by the instructions of) our client.

WHERE DO YOU COLLECT PERSONAL DATA FROM?
We might collect Personal Data in the following ways:

Website usage
You can visit FEYDEY and GSED® website without telling us who you are or revealing any personal information about yourself. The only information we gather during general browsing aside from the IP address is mostly anonymous traffic data, including browser information, device information, and language.

Collection of personal data
While you can use our website without giving out your personal information, once you sign up into the FEYDEY and GSED® website, request information, provide feedback, or subscribe to an electronic mailing list, you will be asked to provide personal information. The information you provide (personal information such as your name, email address, organization, child names, ages, etc.) will be processed and stored so that we can contact and respond to your request and/or allow you access to our services. The information is collected only with your knowledge and permission and is kept in various FEYDEY and GSED® databases and mailing lists.

Online bookings
If you book something using the FEYDEY and GSED® website, you may be asked to provide your credit card details. These details are transferred to and handled by our online payment service, hosted outside FEYDEY and GSED®. Credit card information is not retained by FEYDEY and GSED® at any stage of any transaction.

Information from other sources
FEYDEY and GSED® might receive information about you from other sources (e.g., face-to-face meeting, introduction from third-parties, events participation, etc.). In addition, you may provide us with your personal data by corresponding with us by mail, live-chat, phone, videoconference or otherwise. Before the information is added into the various FEYDEY and GSED® databases and mailing lists you are requested to give your explicit consent.

Job applications
Where an application is made by an individual for employment by FEYDEY and GSED® the data will be stored in an electronic database, and this information will be retained according to the data retention policy.

Photography and Video
FEYDEY and GSED® reserves the right to use any photographs, art work, other content, etc., of its customers on its website and in any of its future publications, as stipulated in the Terms & Conditions.

Special Categories of Personal Data
It is likely that some of the personal data we collect and store about [Subscribers] may include special categories of personal data. Special Categories of Personal Data includes details about an individual's race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about health and genetic and biometric data.

Aggregated Data
We may also collect, use and share Aggregated Data, such as statistical or demographic data, which we collect from interactions with [Subscribers]. Aggregated Data may be derived from Personal Data but since it cannot be used to identify an individual, it is not Personal Data.

HOW DOES FEYDEY and GSED® USE THE COLLECTED INFORMATION?
FEYDEY and GSED® uses Google Analytics and Browser Cookies to improve our service, user experience and analyze how the website is used. The information gathered anonymously during general browsing is used to provide an overview of how people are accessing and using the FEYDEY and GSED® website and FEYDEY and GSED® does not use it for any additional purpose (e.g., profiling, marketing, etc.).

FEYDEY and GSED® use your personal data to contact you:

  • For our internal records
  • In response to a request or booking from your part
  • To inform you by sending a newsletter, documents or any other relevant resource
  • To invite you to be involved in FEYDEY International in-person and online classes and activities.
  • To update you with reports and feedbacks
  • To inform you periodically about changes in FEYDEY International offers

FEYDEY and GSED® hold and process [Subscriber's] Data as a Controller, which means we must have a 'lawful basis' for doing so. We have set out how we use [Subscribers] Data along with our lawful basis in the table below.

Anywhere we rely on legitimate interest, we believe that such processing is necessary for our legitimate interest, which in this case is to function as a business. We consider such use goes no further than the Data Subject would reasonably expect, is likely to align with the Data Subject's interests (by enabling us to provide a sustainable business model) and is unlikely to be detrimental to the fundamental rights and freedoms of the Data Subject.

To register subscribers, to provide additional information for marketing, for Administration and Dispute Resolution, to deliver educational service, FEYDEY and GSED® collect the following type of data:

Identity Data, Contact Data, Transaction Data, Profile Data, Traffic Data under lawful basses: Necessary for the performance of the contract for the provision of our services or taking steps necessary to enter into a contract, Legitimate Interest, Consent.


INFORMATION SECURITY
FEYDEY and GSED® cares to ensure the security of your personal data: we do not sell or share any personal data to any third party except when it's necessary to complete FEYDEY and GSED® functions. Personal data is not used in ways other than as set forth in this privacy policy or in ways to which you have explicitly consented.

FEYDEY and GSED® staff who have access to, and are associated with the processing of personal data, are obliged to respect the confidentiality of official business matters, including personal data.

FEYDEY and GSED® websites are secure, encrypted, and professionally managed to the highest standards. All necessary measures are taken to protect personal data against theft or compromise according to industry practices.

The FEYDEY and GSED® website provides links to other FEYDEY and GSED® websites and features plug-ins for FEYDEY and GSED® social media pages (i.e., Facebook, Instagram, Twitter, etc.). Once clicked upon, you will be taken to different websites with their own specific privacy policies you are recommended to consult. FEYDEY and GSED® is not responsible for the privacy practices or the content of such sites.


INFORMATION SHARING AND DISCLOSURE
We do not disclose your personal data except in the limited circumstances described here:

  • User Consent or Direction: we may share or disclose your information upon your request/consent;
  • Legal process or enforceable governmental request: we may share or disclose your information to comply with a law, regulation, legal process, or governmental request;
  • We may share or disclose your information to detect, prevent, or otherwise address fraud, security or technical issues;
  • Non-personal, anonymized, aggregated data: we may share or disclose this information as part of a project, research, collaborative, etc. that serves the FEYDEY and GSED® business.

WHAT SECURITY PROCEDURES DO YOU HAVE IN PLACE?

It is our policy to ensure that all Personal Data held by us is handled correctly and appropriately according to the nature of the information, the risk associated with mishandling the data, including the damage that could be caused to an individual as a result of loss, corruption and/or accidental disclosure of any such data, and by any applicable legal requirements.


WHAT RIGHTS DOES A DATA SUBJECT HAVE ABOUT THE PERSONAL DATA FEYDEY and GSED® COLLECT AND HOLD?
Data Subjects have the following rights in respect of Personal Data relating to them which can be enforced against whoever is the Controller.

a. Right to be informed: the right to be informed about what Personal Data the Controller collects and stores about you and how it's used.

b. Right of access: the right to request a copy of the Personal Data held, as well as confirmation of:
- the purposes of the processing.
- the categories of personal data concerned.
- the recipients to whom the personal data has/will be disclosed.
- for how long it will be stored; and
- if data wasn't collected directly from the Data Subject, information about the source.

c. Right of rectification: the right to require the Controller to correct any Personal Data held about the Data Subject which is inaccurate or incomplete.

d. Right to be forgotten in certain circumstances, the right to have the Personal Data held about the Data Subject erased from the Controller's records.

e. Right to restriction of processing: the right to request the Controller to restrict the processing carried out concerning Personal Data relating to the Data Subject. You might want to do this, for instance, if you think the data held by the Controller is inaccurate and you would like to restrict processing the data has been reviewed and updated if necessary.

f. Right of portability: the right to have the Personal Data held by the Controller about the Data Subject transferred to another organization, to the extent it was provided in a structured, commonly used and machine-readable format.

g. Right to object to direct marketing: the right to object where processing is carried out for direct marketing purposes (including profiling in connection with that purpose).

h. Right to object to automated processing: the right not to be subject to a decision based solely on automated processing (including profiling), which produces legal effects (or other similar significant effects) on the Data Subject.

ii. If we are not the Controller, we will need to transfer your request to the Controller – but we will only do so with your consent.

iii. If you do contact us with a request, we will also need evidence that you are who you say you are to ensure compliance with data protection legislation.


INFORMATION CORRECTION & DELETION
Providing personal data on the FEYDEY and GSED® website is optional. You can choose not to provide personal data; this will allow you to browse and use the FEYDEY and GSED® website, but you will not be able to carry out certain actions (e.g., make a booking, access booking history, etc.).

Suppose you are a registered FEYDEY and GSED® website user and have a login. In that case, we provide you with tools and account settings to access the personal data you provided to us and associated with your account.

Suppose you are not a registered user but FEYDEY and GSED® have your personal data. In that case, you can contact FEYDEYand GSED® and request an electronic version of all the personal data FEYDEY and GSED® have about you.

If you do not want to receive e-mail, or to be contacted by us in any way, all marketing emails sent by FEYDEY and GSED® contain a link to automatically un-subscribe. You can use this link, or you can also contact us to issue a request by using the Contact Form.

Suppose at any point you wish for FEYDEY and GSED® to delete information about you. In that case, you can contact us via a similar link to issue a request for secure deletion, or you can also contact us using the Contact Form.

Where a commercial transaction has taken place, such as a booking, or where other information has been supplied, such as applying for a job, FEYDEY and GSED® reserve the right to retain the information for any of accounting, legal, or safeguarding reasons.


WHO DO I COMPLAIN TO IF I'M NOT HAPPY WITH HOW YOU PROCESS PERSONAL DATA ABOUT ME?

DATA RETENTION
We retain personal data for as long as the user account is active or otherwise for a limited period of time as long as we need it to fulfil the purpose for which we have initially collected it, and where there is legitimate interest.

Please read these terms and conditions carefully before purchasing an online course or on-campus course taught in person and print off a copy for your records.
Suppose there is any conflict between our Website Disclaimer, these terms and conditions and any Course Specific Terms and Conditions which might apply to a specific online course or on-campus course taught in person. In that case, the conflict shall be resolved by applying the following order of priority:

1. Definitions
"Confidential Information" means the information provided by one party to the other in written, graphic, recorded, machine-readable or other form concerning the business, clients, suppliers, finances and other areas of the other party's business or products, including, without limitation, the Course Materials, but does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.
"Course Materials" means the information provided by FEYDEY, GSED® or Grade Results® to accompany a course provided as part of the Services in hard copy or electronic form.
"Fees" or "Price" or "Cost" means the fees paid by you to FEYDEY or Swiss Innovators Club for the Services.
"Intellectual Property Rights" and/or ® and/or © and or TM means copyright, rights in or relating to databases, patent rights, performers' rights, designs and registered designs, trademarks, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.
"Online Course" means the delivery by us of an online course according to which you learn course materials remotely through FEYDEY – Grade Results LMS (Learning Management system), independently online, through webinars and live instruction.
"Services" means the provision of the online course or on-campus course taught in person and the course materials together with such other services as agreed from time to time and purchased by you through the Website, e-mail, social media or by telephone.
"Course" means a learning material (content) taught by us in a classroom setting, on campus, to which you attend in person or delivered through FEYDEY-Grade Results LMS, online, through webinars and live instruction.
"Website" means https://swissinnovatorsclub.ch and www.feydey.com and www.feydey.ch and www.gsed.ch and www.feydey.org and www.feydey.co.uk and www.feydey.online and  www.swiss-american.org and www.feydey.eu and www.feydey.group 
 
"you" or "customer" means the individual or their legal representative (parent or guardian) purchasing the Services.


2. The Services

2.1. A description of the Services and the dates on which the Services will begin are available on our website. We will provide the Services with reasonable care and skill by the description set out on the website.

2.2. We reserve the right to vary or withdraw any of the Services described on the website without notice.

2.3 We expect you to confirm that the Services you are purchasing will meet your needs. We guarantee to provide quality Services but do not guarantee that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.

3. Ordering Services
Purchasing Services via the Website

3.1. To purchase any Services online, you must register for an account with us via the website. If you already have an account with us, you can log into your account using your username and password.
Purchasing Services via the Telephone

3.2. To purchase a Service over the telephone, please call + 41 24 477 6000 or WhatsApp + 41 79 133 6000. You do not need to have registered for an account with us to purchase any of the Services over the telephone. You must, however, register for an account with us to access your course online.
Purchasing Services via the E-mail

3.3. To purchase a Service by email, please send an email to: Reg@swissinnovatorsclub.ch. You do not need to have registered for an account with us to purchase any of the Services over the telephone. You must, however, register for an account with us to access your course online.

3.3. When you order a Service via the Website, telephone or email, you offer to purchase the Services on these terms and conditions. FEYDEY and GSED® reserve the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with clause 3.5 below.

3.4. We will contact you to confirm receipt of your order for Services via the Website or on the telephone or by email we will contact you confirming receipt of your order.
3.5. A legally binding agreement between us and you shall come into existence when we have:
(a) accepted your offer to purchase Services from us by sending you an email confirming the purchase and
(b) received payment of the relevant Fees from you in accordance with clause 5 below.

3.6. Where your order consists of multiple online courses or multiple courses taught on campus in person, we will treat each course will be treated by us as a separate offer to purchase. We will not accept your offer to buy one or more courses or offer to purchase any other courses that make up your order.

3.7. FEYDEY is not responsible for booking any examination with any professional body or examination board. It is your responsibility to ensure that you book any exam you wish to take before the relevant closing date, which may or may not be associated with the subject matter of the Services provided to you by FEYDEY.


4. Cancellation and Variation

4.1. Subject to clause 4.2 below, where we have accepted/confirmed the Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.5 above, then you are permitted within 3 (three) days starting on the day after the date we have concluded our agreement in accordance with clause 3.4, before the payment for courses settled from your side to cancel your purchase of the Services. 

After the payment, of course, settled from your side in accordance with clause 3.4 of our agreement, the following terms of cancellation and variation are in place:

4.1.1 If you have purchased an Online Course and have already received a username and password of FEYDEY-Grade Results LMS, there is no other right to cancel or vary your Services purchase or request any refund. 
During the academic year, any other cancellation and/or variation of course dates will be at the entire discretion of FEYDEY or GSED®.
If you have purchased an online course and have a scheduled payment structure, you will be obliged to pay the fees planned thoroughly, even if you stop learning at your own decision.
a. Registration fee is not refundable
b. Tuition fees are not refundable

4.1.2. If you have purchased a Course taught in person at one of our schools, institutes or camps worldwide:
a. Registration fee is not refundable
b. Tuition fees are refundable 100% 90 days before the course starts days
c. Tuition fees are refundable 50% 60 days before the course starts days
d. Tuition fees are refundable 25% 30 days before the course starts days
e. Tuition fees are NOT refundable less than 30 days before the course start days
f. The deposit is refundable at the end of the tuition period, excluding fees of any unpaid or not settled bills, damages or unpaid bills to the third parties related to provided services by FEYDEY or Swiss Innovators Club.
g. For boarding school students, there will be special rules of two-term notice for cancellation policy to refund the remaining funds.

4.2. Notwithstanding clause 4.1 there is no other right to cancel or vary your purchase of Services and any other cancellation and/or variation of course dates will be at the entire discretion of FEYDEY or Swiss Innovators Club.

4.3. Any disputes concerning payments and refunds shall be governed and resolved in accordance with the Complaint Procedure, which forms an integral part of the Policies and Procedures.


5. Fees

5.1. The Fees for the Services shall be as set out on the Website or as told to you over the telephone when you place an order for them or described in detail in the email you received from us, and all these options paid by the bank transfer based on invoice or a provided payment link sent to you by email or on the website, forwarded to the payment page after filling up the registration form.

5.2. Unless otherwise specified at the time you purchase the Services, the Fees are exclusive of VAT or other local taxes, the cost of additional or supplementary course materials and any delivery costs payable regarding the delivery of the course material to you. Each of these costs will be set out in the Website, described in the email or told to you over the telephone before you purchase the Services.

5.3. Save where specifically stated otherwise on the Website, all Fees shall be exclusive of any amounts payable to any professional body for registration and examination entry. These are payable by you directly to the relevant professional body or examination board and we accept no responsibility or liability for your failure to book your exam with the appropriate professional body or examination.

5.4. Fees for the Service selected by you on the Website or purchased over the telephone or by email shall be debited from your credit/debit card at the time of purchase. 
Alternatively, an invoice for bank transfer can be requested to the Swiss Innovators Club’s official UBS Bank account. 
Fees must be paid in full, according to the deadlines or schedules notified in the invoice, before you can attend any course taught on campus in person or access any online course.
Any payments scheduled after the course start day must be paid strictly on time.
Any delay in scheduled payment will cause the first immediate reminder about payment during three (3) banking days.
If delayed payment is not settled within three (3) banking days from the day of scheduled payment and an additional agreement is not achieved in writing as a signed document, FEYDEY or Swiss Innovators Club have the rights to stop immediately providing Service and terminate a legally binding agreement with you in accordance with clause 3.5 above.

5.5. Any fees related to bank transfer or charged by your debit or credit card provider in connection with your purchase of Services are your expenses and for your account, FEYDEY or Swiss Innovators Club shall not be responsible for these expenses and will be identified in your invoice as additional expenses besides tuition and other related costs.

5.6. You shall be responsible for all primary and related costs you incur concerning your attendance at any Courses taught on campus in person or your access to any Online Course.

5.7. Service can only be confirmed if the agreed deposit or registration fee is fully paid. 
No Services can be provided if deposit and/or registration fees and tuition fees are not fully paid.
If tuition fees, deposits, and/or registration fees are scheduled for payment, the first instalment must be fully paid before providing any Services.

7. Liability

7.1. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.

7.2. Although FEYDEY aims to provide the Services to the highest standards of the industry, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the programmes or Course Materials and any reliance by Client on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.

7.3. Except to the extent that they are expressly set out in these terms and conditions, no conditions, warranties or other terms shall apply to the Services. Subject to clause 7.5 no implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

7.4. Subject to clause 7.5 below, FEYDEY's total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by us in connection with the relevant Online Course or Course taught on campus in person about which a dispute has arisen.

7.5. Nothing in this Agreement shall exclude or limit FEYDEY's liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation or (iii) any other matter which under Swiss or U.S. law may not be limited or excluded.

7.6. No claim may be brought more than six months after the last date on which we finished or ceased to provide the Services concerned.


8. Intellectual Property

8.1. All Intellectual Property Rights, registered and unregistered copyrights related to the mentioned brand names and institutions (FEYDEY, GSE®, GSED®, Grade Results®, Swiss Innovators Club) in the presented Course Materials, LMS Content, teaching Pedagogy, Academic Concepts, Online Courses, Projects for PBL, Tests, Olympiads, Learning Activities, and the speeches made by trainers at the Courses taught on campus in person, video, audio, and photo materials, research, and findings made by students and teachers are, and remain, the intellectual property of FEYDEY, Grade Results, GSED®, Swiss Innovators Club, or its licensors, whether adapted, written for, or customized for the Client or not.

8.2. You are not authorized to:
(i) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the online or other Course Materials without prior written permission.
(ii) record on video or audio tape, relay by videophone or other means the Online Course or Course taught on campus in person given by us in writing.
(iii) use the Course Materials in the provision of any other course or training whether given by us in writing.
(iv) remove any copyright or other notice of FEYDEY on the Course Materials.
(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
Breach by you of this clause 8.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.

8.3. In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive license to use the Course Materials and the software in respect of the Online Course for the sole purpose of completing the Online Course and / or attending the Taught Course.


9. Confidentiality

9.1. Each party shall keep the other party's Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions and shall return it on demand and not retain copies of it.

9.2. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.

9.3. This clause shall continue notwithstanding termination of these terms and conditions.


10. Termination

10.1. We shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect in the event that you:
  1. fail to pay when due your Fees.
  2. act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of FEYDEY, any teacher or lecturer who provides the Courses taught online or on campus in person or any student who attends any Course taught online or on campus in person.
  3. cheat or plagiarise any work which you are required to prepare or submit in connection with the Services or during any examination taken in connection with the Services.
  4. steal or act in a fraudulent or deceitful manner towards us or our employees or any other students who may be on our premises or attending our Taught Courses online or on campus in person.
  5. intentionally or recklessly damage our property or the property of our employees or other students attending our premises.
  6. are intoxicated through alcohol or illegal drugs while on our premises or online.
  7. commit any criminal offence committed on our premises or online or where the victim is our employee or student.
  8. are in breach of these terms and conditions.
10.2. On termination, clauses 7 (liability), 8 (intellectual property rights), 9 (confidentiality) and 10 (termination) shall continue notwithstanding such termination.


11. Assignment

Any Services we provide under these terms and conditions are personal to you and cannot be transferred or assigned to anyone else.
We shall be entitled to assign these terms and conditions to any other company or individual without prior notice.
All accepted/confirmed Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.5 above can be transferred to the third party.


12. Entire Agreement

These terms and conditions, together with the Website Disclaimer and Course Specific Terms and Conditions, are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering these and any other terms and conditions with us. Nothing in this clause or these terms and conditions shall limit liability for any fraudulent misrepresentation.

13. Force Majeure

FEYDEY shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, pandemics, failure to provide a course caused by a death in the trainer's family, illness of the trainer, Government mandate or regulation.


14. Data Protection

14.1 The nature of the Services provided by us means that we will obtain, use and disclose (together "Use") specific information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing the Services, you agree to this Use.

14.2 When you register with us, you will need to provide certain Data, such as your contact details and demographic information. We will store this Data and use it to contact you, provide you with details of the Services you have purchased, and otherwise as required during the normal course provision.

14.3 We may also use the above Data, and similar Data you provide us in response to surveys to aggregate user profiles and, unless you click on the relevant button on the Registration Form, provide you with communications. We will not pass any personal data onto anyone outside of FEYDEY, Swiss Innovators Club and Grade Results except the entities officially listed in the FEYDEY Privacy Policy.

14.3 To enable us to monitor and improve our Services, we gather certain aggregated information about you, including details of your operating system, browser version, domain name and IP address, the URL you came from and go to and the parts of the Website you visit.

14.4. We use information such as your User ID, session identifiers, and password to determine whether you are using our services, assist with service provision, and ensure that you have access to relevant products. We will only read cookies from your cookie file placed there by your web browser's interaction with the Website.

14.5. Our products may link to third-party websites, and we are not responsible for their data policies, procedures, or content.

14.6. FEYDEY endeavours to take all reasonable steps to protect your personal data, including encryption technology, but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of transacting online over the internet and will not hold us responsible for any security breach.

14.7. FEYDEY may supplement the information that you provide with information we receive from third parties, such as exam registration bodies or your employer.

15. Law and Jurisdiction

This Agreement is subject to Swiss and US law, and the parties submit to the exclusive jurisdiction of the Swiss courts, canton Vaud, or the State of California, USA, in connection with any dispute hereunder.

COPYRIGHT
All content included on the FEYDEY websites listed in clause 1, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of FEYDEY and affiliated companies or its content suppliers and protected by United States, Europe and international copyright laws. 
The compilation of all content on the FEYDEY Websites is the exclusive property of FEYDEY its content suppliers and is protected by U.S., European and international copyright laws. 
All software used on the FEYDEY Website is the property of FEYDEY or its content suppliers or its software suppliers and is protected by United States and international copyright laws.


TRADEMARKS
"Feydey", "FEYDEY Pedagogy", "FEYDEY Online School", FEYDEY Virtual Camp", "Global Secondary Education", "GSE®", “GSED® Pedagogy”, “Grade Results”, "Global Secondary Education Diploma", “GSED®”, "IMT Class", IMT Class World" and other FEYDEY graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of FEYDEY in the U.S. and/or other countries. 
FEYDEY's trademarks and trade dress may not be used in connection with any product or service that is not FEYDEY's, in any manner that is likely to confuse customers, or in any manner that disparages or discredits FEYDEY. All other trademarks not owned by FEYDEY that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by FEYDEY.


User Representations
For the use of the Websites, you agree that:
1. No false information will be provided, and no one else will be impersonated in the use of the Websites.
2. Only the username and password dedicated to you will be used in the Sites.
3. The confidentiality of the username and password will be maintained at all times.
4. No one else will be assisted in gaining unauthorized access to the Sites.

You also agree that no personal information like name, address, phone number, or school name of students under 18 be collected without parental consent.



SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies on the FEYDEY Site. These policies also govern your visit to the FEYDEY Site. We reserve the right to change the FEYDEY Site, policies, and these Site Terms at any time. 
Suppose any of these conditions shall be deemed invalid, void, or unenforceable. In that case, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.


Miscellaneous
Governing Law – These Terms shall be ruled by and interpreted with the laws of Switzerland, canton Vaud, without reference to any conflicts of law principles that would result in applying the laws of another jurisdiction. 
You agree that any legal action or proceeding concerning your use of the Websites shall be brought exclusively in a Swiss court in canton Vaud, and you submit to the exclusive personal jurisdiction of such courts.
